It has been suggested to Macao by Lisbon that matter should be referred to a tribunal of three, one Portuguese, one Chinese and a "casting vote" (Pas) modus vivendi pending

delimitation.

Macao has rejected this and rightly so in my opinion and has put forward arbitration by foreign consul or other high official nominated jointly.

I consider this equally unsatisfactory, because I

(? cannot) visit Portuguese Minister if Chinese do not agree

to accept his mediation (see Peking telegram No. 369).

I am consulting Chinese on above in writing today, and have added on my responsibility, suggestion that harbour and waters question be submitted to His Majesty's Supreme Court at Shanghai, as being without local prejudice and, therefore, impartial,
